HM Courts and Tribunals Service is responsible for the administration of criminal courts, civil courts, family courts and tribunals in England and Wales working with an independent judiciary to provide a fair, efficient and effective justice system.

Currently, HM Courts and Tribunals Service is embarking on a period of significant change which will require strong leadership in this critical role, operating in a culture of openness and honesty.

Overview:

The Kings Bench Division, which includes the Administrative Court is one of the three divisions of the High Court. The cases most commonly handled are disputes relating to personal injury, clinical negligence, breach of contract, libel and slander, and in the Administrative Court Judicial Review.

The County Court deals with the vast majority of civil (non-criminal) matters.

Unlike criminal cases - in which the state prosecutes an individual - civil court cases arise where an individual or a business believes their rights have been infringed.

Types of civil case dealt with in the County Court include:

  • Businesses trying to recover money they are owed;
  • Individuals seeking compensation for injuries;
  • Landowners seeking orders that will prevent trespass.
All County Court centres can deal with contract and tort (civil wrong) cases and recovery of land actions.

Some hearing centres can also deal with bankruptcy and insolvency matters, as well as cases relating to wills and trusts (equity and contested probate actions) where the value of the trust, fund or estate does not exceed £30,000, matters under the Equality Act 2010, and actions which all parties agree to have heard in a county court (e.g.

defamation cases).

Senior Courts Costs Office is a distinct part of the High Court. It deals with all aspects of costs from each division of the High Court, from Court of Appeal (Civil Division), Court of Protection, tribunals as well as all the London County Courts. The primary function is the assessment of costs and expenses which are recoverable from one litigant by another or by a lawyer. These assessments are undertaken by Costs Judges and Costs Officers.

High Court Family is based within the Queens Building in the main Royal Courts of Justice estate this is a busy court that deals with both complex and sensitive family and medical matters including Forced Marriage, Female Genital Mutilation, Public and Private Law cases, High Value Financial Remedy, Child Abduction, Court of Protection matters and appeals. The President is the head of the Family Division and sits alongside 20 High Court Judges who sit both at the Royal Courts of Justice and on Circuit outside of London. Due to the time sensitive nature of the work that is heard within the Court the Court we often sit Courts throughout the traditional vacation period.

The Court of Appeal Criminal Divisionhears appeals against convictions, sentences given by the Crown Court (even if the conviction was in a magistrates' court) and confiscation orders imposed by the Crown Court

The Court of Appeal Civil Division hears appeals across all civil jurisdictions including in the following areas: immigration and asylum, family, judicial review, possession, commercial, defamation, personal injury, insolvency and employment. In the majority of cases, it is the final court of appeal. The Civil Appeals Office provides administrative and legal support to the Court of Appeal Civil Division.
