About this job:


  • Job Purpose:
  • Advise schools on the appropriateness of instituting legal proceedings for irregular school attendance, including advice on the plan of action; available options; timeframes and when legal proceedings are not appropriate.
  • Undertake quality assurance of legal work, generated by schools, relating to irregular school attendance.
  • Maintain cohesion between schools and the Local Authority Legal Department in relation to the flow of information pertaining to the legal work for irregular school attendance.
  • Ensure borough policies and procedures, relating to legal work and irregular school attendance, are maintained and accessible.
  • Provide training to schools on the law relating to school attendance and on borough procedures.
  • Oversee and issue Fixed Penalty Notices for unauthorised absence on behalf of schools.
  • Prepare court case documentation in response unpaid penalty notices.

Special requirements for this post:


Advise schools on what types of legal proceedings are available; what needs to be done to prepare a court case; how to request a penalty notice; when legal proceedings are not appropriate.


Ensure all legal work complies with the law and borough procedures, including rules of evidence; quality of work; timeframes & deadlines.

Contribute to successful prosecutions in court by quality assuring witness statements and preparing other paperwork prior to submitting them to the Legal Department.

Quality assure penalty notice requests and issue them in a timely and fair manner. undefined. Provide advice, guidance and training to agency and school staff on legal work relating to irregular school attendance.

Ensure systems used (including commissioned work) for bringing cases to court are efficient, effective and up to date.


Ensure that the borough's Penalty Notice Code of Conduct is adhered to, reviewed and published at least annually in light of national guidance and changes in the law.

Help develop and maintain other borough guidance documents and policies relating to legal work and irregular school attendance. Manage all aspects of work relating to School Attendance Orders i.e.

following SAO process, liaising with parents and schools as required, and prepare court cases in response to non-compliance with an SAO.

For each court case, decide if an Education Supervision Order is suitable or not.

Be the supervising officer for all Education Supervision Orders. Attend court where required to present evidence in relation legal cases.

Compile reports and provide data as required in relation to key performance indicators, Freedom of Information requests and data returns for the Department for Education.


Keep up to date with regards to current guidance and legisliation in relation to school attendance and legal measure to address irregular attendance.


About you:

Knowledge, Skills and Experience Considerable experience of working within the education sector.

Has a good understanding of the laws around school attendance and how they are applied.


Communication, Contacts and Relationships Can engage and communicate effectively with a wide range of senior professionals in a way that is positive, analytical and constructive, with strong attention to detail.

Equalities and Diversity Experience of working within diverse communities and how this applies to education provision.

Resources, data protection and information governance. Is familiar with the principles of GDPR; understands confidentiality and when information needs to be shared.

Work Demands and Decisions Can successfully priotise tasks to ensure that they are completed within deadline.
