Senior Associate Lawyer - Law and Policy-1


The Enforcement Law & Policy legal team ensures that the FCA has the appropriate powers and public policies to achieve fair and just outcomes in response to misconduct.

We are curious about all aspects of financial services and enforcement policy, and look for creative, pragmatic and legally-sound solutions to the unique challenges we face.


The team advises on a range of Enforcement and cross - cutting FCA issues, often involving legislative change or regulatory reform.

This includes advising on the implementation of HM Treasury's Future Regulatory Framework Review (the FRF Review).

The FRF Review is a government commitment to ensure that the UK's future financial services regulation maintains an approach that is coherent, agile and internationally respected, following our departure from the EU.


We are being granted new powers to enable the transfer of certain areas of retained EU law and with the transfers complete, we will have responsibility for the firm-facing rules.

Implementation of the FRF Review will also involve changes to the FCA's statutory objectives and regulatory principles. There will also be changes to the regulators' accountability and scrutiny mechanisms, and stakeholder engagement.


The team also works with HM Treasury, and other Government departments, providing enforcement-related policy and legal input on the drafting of relevant UK and EU primary and secondary legislation and guidance, which has included preparations for EU withdrawal.

We also advise UK and non-UK financial services and other regulators on the development of their enforcement-related rules, guidance and policies.


These roles present an opportunity to play a vital role contributing to the development of the future regulatory regime, as well as to the wider work of the team.

Please note we have roles at both Senior and Lead Associate Lawyer level.

In deciding what role to offer, we will consider all relevant factors including the extent of relevant skills and experience.

What does the role involve? What are the key responsibilities?

Working as part of a team of lawyers you will be responsible for:

  • Supported by and alongside more senior colleagues in the team, playing a central role in EMO's contribution to the effective implementation of the FRF Review.
  • Contributing to the development of the legal instruments and the underlying policies which will replace relevant aspects of Retained EU Law.
  • Contributing to the development and management of public consultations on amendments to the FCA Handbook.-
  • Focusing on ensuring that under the new regimes, Enforcement has the appropriate powers to fulfil its functions.
  • Collaborating with colleagues of varying degrees of seniority from across EMO, other FCA divisions, HM Treasury and other regulatory partners.
  • Briefing and engaging with decision makers and dealing with challenges on policy choices and delivery.
  • In due course, helping to devise and roll out relevant training to Enforcement colleagues, and provide legal and policy expertise to case teams.
  • Performing an equivalent role in connection with other aspects of the FRF Review, for example planning for the implementation of the proposed new secondary international competitiveness and growth objective.
  • Being flexible when called on to engage on other workstreams ongoing within the team, department or more broadly.

You may also:

  • Contribute to the formation, development and implementation of the FCA's enforcement policies. Law & Policy is responsible for the Enforcement Guide and the Decision Procedure and Penalties Manual in the FCA Handbook, as well as using our approach to enforcement to inform action in authorisations and supervisory work.
  • Provide advice on legal and policy issues relating to enforcement and the exercise of the FCA's powers in crossFCA projects and initiatives by working with and supporting other divisions in the FCA. This could include ensuring that the FCA has the necessary powers in relation to new regulatory duties and analysis and advice on the use of existing powers.
  • Contribute to and work towards taking responsibility for building and maintaining effective working relationships with stakeholders, including at a senior level with colleagues in EMO, other business areas within the FCA and with external bodies.
  • Present and explain legal/policy issues arising within cases to EMO Project Board, and other internal committees and taking opportunities to share knowhow at Legal Roundups.
