My high-profile energy renewable client is currently seeking an experienced Compliance Manager to provide advisory, change management and assurance activities across the group's trading and generation operations.


Purpose of the role:


The postholder will develop and maintain an effective compliance framework that meets the company's regulatory, industry codes and generation licence obligations, protecting the business against regulatory sanctions and reputational risk to preserve thecompany's licence to operate.

The postholder will be required to liaise with stakeholders across the business, including Trading, Generation, Treasury, IT, Risk, Legal and support functions.


Dimensions:


  • Protecting Company's licence to Operate: regulatory sanction risks include reputational damage to business, financial penalties and personal fines/imprisonment
  • Span of responsibilities includes:
  • UK and EU market regulation: Regulation on Energy Market Integrity and Transparency (REMIT), Market Abuse Regulation (MAR), European Market Infrastructure Regulation (EMIR), Markets in Financial Instruments Directive II (MiFID II), European TransparencyRegulation (ETR)
  • UK financial services regulation: Regulatory status under the Financial Services and Markets Act (FSMA) and Regulated Activities Order (RAO)
  • GB licensing regime: Transmission Constraint Licence Condition (TCLC), Grid Code, BSC, CUSC, and Secure and Promote
  • External interactions with regulators (Ofgem and FCA), market operators (Electricity System Operator (ESO), market venues (EPEX, Nordpool)), industry associations (Energy UK and European Federation of Energy Traders (EFET))
  • Detailed engagement and collaboration with commercial (Trading, Treasury, Generation, Risk, Operational Support) and corporate (Group Legal, Company Secretary, Internal Audit) teams

Key Accountabilities:


  • Support Generation and Trading teams, ensuring delivery of consistent advice, guidance, training and assurance in relation to wholesale energy (REMIT, TCLC, Grid Code, ETR and S&P) and financial markets (EMIR, MAR, MiFID II & FSMA/RAO) regulations
  • Facilitate internal risk assessment of existing and forthcoming regulatory requirements, mitigating actions required across the business
  • Aid the development of internal trading surveillance capabilities to identify, escalate, report and rectify issues
  • Facilitate in devising responses to market related investigations and requests for information (RFIs), in relation to our generation/trading activities, received from external bodies
  • Support first, second
- and third-line assurance of support functions across the business, implementing and supporting mitigation strategi

  • Perform third line of defence internal and external audit requirements
  • Develop and maintain a robust compliance monitoring and assurance framework (e.g. timely annual risk assessments, audits, etc.)
  • Perform policy, process, system and capability reviews in line with the latest regulations
  • Horizon scan regulatory developments with regulatory bodies, market providers and industry associations to attain intelligence to recommend best in class Compliance practices across the business
  • Provide compliance representation and support across various business, IT and M&A projects
  • Conduct independent monitoring, reviews and investigations into compliance matters as required
  • Support with mentorship and guidance for junior members of the team

Knowledge, Skills and Experience required:


  • Educated to degree level
  • Experience in project work essential
  • Experience in process improvement essential
  • Critical thinking ability
  • Understanding of trading environment
  • Experience working with commercial teams (including 24hr trading functions), building trust, confidence and respect whilst challenging the status quo
  • Demonstrable track record of leading projects that involve complex data and influencing the operational culture of a business
  • Proven track record of negotiating, influencing and communicating effectively with stakeholders
  • Experience in investigations, including large volumes of data gathering, complex analysis, the interviewing of personnel and developing/presenting conclusions and recommendations to senior leaders
  • Ability to cut through complexity to identify principal impacts and practical options
  • Able to communicate complex issues simply and concisely
  • Ability to work collaboratively in a team environment and support the development of junior staff
  • Understands commercial context, tests theory, facilitates appropriate solutions
  • Constructive in approach, works towards the wider objectives of the team and group
  • Working knowledge of a generation business is preferred
