· Duties and responsibilities
Authority
1.1 The Master is the representative of the Company, and is the highest authority on the ship for safe operation.
1.2 By international law, the Master is the representative of the owner of the ship and the person with the highest authority on board. This authority shall not be transferred to any other person while he is on board the ship or in command.
1.3 Overriding authority
The Master shall have the duty to observe the provisions of the Safety Management System Manuals, and shall also have the authority to take the following actions in order to secure and maintain safe of the ship operation and environmental protection.
a) The authority to make judgments concerning matters that are not covered in this manual, and to act accordingly
b) The authority to make judgments best under the prevailing circumstance, in the event of an emergency, etc., and to act accordingly, even concerning matters which are covered in this manual
c) The authority to request the necessary support from the Company
2. Responsibility
2.1 Operation of Safety Management System
2.1.1 Recognizing the fact that he is the person responsible for the operation of the Safety Management System on board, the Master shall carry out the following:
a) He shall implement and operate the Safety Management System in line with the safety and environmental protection policy of the Company.
b) He shall ensure that the Company policy is impressed on all of the crew members without exception, and motivate them to adhere to it.
c) The orders issued by the Master for the purpose of implementing this policy must be in clear and simple in manner.
d) He shall check and verify that the Safety Management System is functioning.
Such procedure is established in Company’s Work Instruction.
e) He shall review the Safety Management System, and report to the Company any defect which has come to his notice.
2.1.2 Management of the SMS Manual
The Master shall carry out and be responsible for documentation management of the SMS Manual.
2.2 Safety and Environmental Protection
The Master shall strive to ensure the safety of the lives of all crew members, the ship, her cargo, etc., and protect the environment, and be responsible for doing so.
2.3 Responsibilities of the Master and Officers
2.3.1 While this regulation specifies the duties and responsibility of each officer, the Master shall not be relieved, partially or entirely, of his responsibility by the duties and responsibility of each officer.
2.3.2 The Master shall be responsible to ensure that each officer performs his duties completely. He shall ensure that each officer reads carefully this manual and the relevant instruction books, and carries out his duties on the basis of a thorough understanding of them.
2.3.3 The Master shall recognize the fact that he himself is responsible for any mistakes or negligence of the officers, who are under his supervision, in the performance of their duties.
2.3.4 The Master shall recognize that he is responsible for pointing out and rectifying any infraction of rules or lack of skills or knowledge when officers perform their duties.
3.0 Managing the Catering Department
a) As a general rule, the Catering Department does not have a department head, but shall be controlled directly by the Master, who must provide guidance and supervision.
b) If the department head of the Catering Department is nominated by instructions from the Chief of Marine Administration, the Master shall indicate this fact in writing in the form of a Letter of Instructions or a Letter of Nomination, and add the contents thereof to this regulation.
c) The Master himself shall control the purchase and consumption of provisions and food materials, even when the department head of the Catering Department has been nominated.
