THE COMPANY:
Our client is a leading provider of execution and clearing services for exchange traded derivatives and OTC derivatives in the commodities markets.
THE RESPONSIBILITIES:
- Monitor and ensure ongoing compliance with all legal and regulatory requirements
- Proactive researching of the regulatory environment, keeping the business informed of all upcoming legislation and ensure timely implementation of all requirements
- To continue and improve compliance monitoring programs which test the adequacy of business procedures necessary to achieve regulatory compliance.
- Focal point for the oversight of all activities relating to the prevention, detection and reporting of Money Laundering and financial crime.
- To support and guide the firm on financial crime obligations.
- Maintenance of FCA Compliance Manual and all compliance policies and procedures.
- To provide formal reports to management and committees on all aspects of compliance and regulatory controls.
- To immediately escalate to the CEO and Head Office (and Board if appropriate) any rule breaches
- Provision of Compliance advice to the business on an ongoing basis.
- To manage the administration of employees personal account dealings, the gifts and entertainment procedures, outside business interests, sign off of client facing material.
- Training of all staff and senior management in relevant compliance matters and develop an internal culture of good conduct and compliance
- To ensure appropriate review of customer complaints and maintenance of FCA required complaints records.
- To prepare required regulatory customer documentation and keep documents updated to reflect regulatory developments, ensuring proper classification of customers, customer due diligence and record keeping.
- To ensure appropriate registration of staff as FCA Certified Persons, advise on relevant courses, training and exams; ensure the necessary FCA induction and training is undertaken and recorded; check and file FCA Certified Persons Forms.
- Compliance reporting to Hong Kong and wider group
- Completion and submission of nonFinancial FCA returns
- Undertaking of full annual compliance reviews and further adhoc reviews as required
- Principal point of contact for FCA, LME and LME Clear for all compliance issues
- Attendance at regular meetings of FCA, LME, FIA and other relevant forums to ensure the company remains up to date with all regulatory changes
- Other ad hoc duties as assigned by the management.
EXPERIENCE REQUIRED:
- Very strong knowledge of FCA Handbook and related European Regulations
- Demonstrable ability to identify, interpret and advise upon rules, action requirements, change management and business implications
- Experience at a senior level handling FCA and equivalent relationships.
- Experience in commodity derivatives out of multiple jurisdictions, both on exchange and OTC, preferably with a wholesale client base.
