    Description

    To be a key member of the Commercial team, responsible for providing a comprehensive advice and drafting service on contracts, agreements and procurement issues.

    To deal with company, commercial, partnership, unincorporated bodies, trusts, and associated matters for the Council and external clients.

    To help with other areas of the work of the Commercial Team and Legal Services as may be required.

    Assist in the management of the Commercial Team and contribute to the overall management of Legal Services

    MAIN DUTIES/RESPONSIBILITIES

    1. To advise on, draft and amend agreements, contracts and other legal documents.

    2. To advise on procurement procedure and issues and draft or amend relevant documentation.

    3. To deal with company and commercial matters, including companies searches, formation, responsibilities, local authority trading, partnerships, joint ventures and other arrangements with outside bodies.

    4. To deal with partnership, joint working agreements and other arrangements with outside bodies.

    5. To deal with issues relating to the constitutions of unincorporated bodies.

    6. To deal with the formation of trusts and issues concerned with the management of trusts.

    7. To advise on issues relating to contractual and procurement disputes and any litigation that arises and to work jointly with colleagues in dealing with such litigation.

    8. To attend and present cases (subject to rights of audience) at courts, panels and hearings, as required

    9. To keep under review, research and advise on factual and legal matters (including the impact of new legislation and cases) so far as it relates to the job purpose.

    10. To provide a strategic and proactive legal service within the remit of the job purpose, by seeking to anticipate issues and become involved with ideas, initiatives and projects at an early stage.

    11. To establish and maintain effective working relationships with key clients and stakeholders.

    12. To attend such meetings, with officers, members, clients, stakeholders, or other persons as may be required.

    13. To attend at Council committees or sub committees consistent with the duties of the post.

    14. To advise, comment on and write reports as appropriate.

    15. To devise and deliver appropriate training, seminars and courses for staff, members, clients and others.

    16. To ensure that all matters within your care and conduct are properly and expeditiously progressed in accordance with best practice.

    17. To ensure that you follow relevant policies, office procedures, quality and practice management standards.

    18. To support members of the Commercial Team in dealing with the more challenging aspects of their work by the appropriate level of involvement.

    19. Ensure that you work in line with all the Council's policies and procedures and ensure that you are aware of your obligations under these.

    20. Behave according to the Employees' Code of Conduct and ensure that you are aware of your obligations and responsibilities re: conflicts of interest, gifts, hospitality and other matters covered by the Code.

    21. Carry out your role in line with the Council's Equality agenda.

    22. To comply with health and safety policies, organisational statements and procedures, report any incidents / accidents/ hazards and take a pro-active approach to health and safety matters in order to protect yourself and others.

    23. Any other duties of a similar nature related to this post that may be required from time-to-time.

    This post is subject to an enhanced disclosure. The successful applicant will be subject to the relevant vetting checks before an offer of appointment is confirmed. Following appointment the employee will be subject to rechecking as required from time to time by the Council.
