    Job summary

    The R&D Department currently processes many research applications every month and for the majority of these research studies contracts are required. The R&D Department co-ordinate's the setup of research studies and manages the necessary contracts.

    We require a Contracts Manager to work with the R&D Governance team to provide initial drafts, review and negotiate research related contracts. This will involve negotiation with other Trusts and research organisations on any potential problems as well as liaison with the governance team to ensure that all aspects of a complex research collaboration have appropriate contracts in place. The post holder will also review other contracts relating to research such as those issued by the Department of Health.

    Main duties of the job

  • Provide advice to research staff within the Trust in the negotiation and management of the terms of contracts relevant to research.
  • Ensure that contractual terms are clear and appropriate, and that institutional risk is identified and appropriately assessed within each contract. Actively keep up to date with all relevant research guidance and legislation. Provide accurate and relevant advice on the research guidance and legislation to the R&D Department and to researchers.
  • Contribute to regular reviews of the Trust's policies and procedures for research and research related themes.
  • Liaise with other Trusts and third party support departments on related contractual issues in particular financial schedules, VAT, equipment procurement, pharmacy, human tissue and information governance.
  • Provide support to the governance team with their review of template agreements.
  • Support the Trust on matters of research related IP.

  • Initiate and review research related contracts and negotiate with other Trusts, Universities, Pharmaceutical companies, and research organisations (both nationally and internationally) on any potential problems so that the Trusts interests are protected.
  • The post holder will also review other contracts relating to research such as those issued by the Department of Health and advise on legal issues relating to research in the health service with responsibilities to:

  • Draft, review and negotiate highly complex contracts and agreements for research studies that involve the Trust and ensure those agreements protect the Trusts interests and those of its patients.
  • Analyse complex contractual and legal obligations in the light of available guidance and potentially conflicting evidence.
  • Research and advise independently on the interpretation and compliance with statutory or regulatory matters and the interpretation of Trust policies and procedures to members of the R&D Department and to researchers.

    Essential

  • Post graduate qualification in a field relevant to research
  • A degree in law or equivalent qualification

  • Evidence of continuing professional development

  • Knowledge of clinical research governance
  • Ability to communicate, negotiate and influence effectively as appropriate at all levels and be persuasive and assertive when required

  • An understanding and/or experience of the finance systems for research organisations
  • Contract management, contract law and commercial negotiation or financial analysis
  • Experience

    Essential

  • Experience of working with contracts
  • Experience of negotiating contracts in a life science or research setting

  • Experience of working in a clinical research environment in an NHS Trust, University, pharmaceutical company, charity or other organisation
  • Experience of analysing and interpreting complex contractual terms and/or research management information
